LEER MÁSJ.S. Held's Surety Services team was retained by legal counsel for a large residential home builder facing multiple lawsuits detailing construction defects in the work performed by the builder. The allegations highlighted similar defects across residential properties in multiple phases of construction, including roof, stucco, concrete, drywall, and leaks in windows and sliding glass doors.
The builder addressed some of the repairs directly, but J.S. Held Surety experts were retained to provide expert reports, a scope of repair, and a cost analysis of the remaining defects. Our experts provided visual site observations and attended and documented the results from intrusive testing and photo-documentation for each home during site visits. Additionally, we provided both preliminary and final expert reports addressing all alleged defects and, when applicable, a scope of repair and the cost of repair per defect in both reports. J.S. Held Surety expert Tom Tomeo testified at a deposition on some of the files, but most settled before the deposition stage.
Due to J.S. Held’s expert opinions relating to the scope of repair and cost analysis of the alleged defects, several of the lawsuits settled well below the original Plaintiff’s demands.
